Retslav Hosting Terms of Service

1. Acceptance of Terms
By using any of our hosting services, you acknowledge that you have read, understood, and agreed to abide by these Terms of Service (TOS). If you do not agree to these terms, please do not use our services.

2. Application & Agreement
2.1 Agreement Acceptance: Retslav Hosting provides products and services only to customers who have agreed to these terms and conditions.

2.2 Governing Law: These terms and conditions are governed by Dutch law.

2.3 Changes: Retslav Hosting is authorized to change these terms and conditions at any time without notice.

2.4 Start of Agreement: The agreement commences when the customer receives an email confirming the order.

2.5 Partial Validity: If any part of the agreement is found to be legally invalid, it does not affect the validity of the rest of the agreement.

2.6 Truthful Information: Retslav Hosting expects customers to provide truthful information during registration and to register only for themselves unless they have custody or parenthood of the person they are registering for.

2.7 Marketing Emails: Retslav Hosting will never send marketing-related emails without an unsubscribe option and prior customer permission. Unsolicited messages will not be sent.

3. Delivery & Obligations
3.1 Product Delivery: Retslav Hosting strives to deliver products within 24 hours unless stated otherwise in the product description.
3.2 Payment Requirement: Products are delivered only when the corresponding invoice is marked as paid.
3.3 Product Specifications: Retslav Hosting guarantees that the product meets the specifications and conditions stated in the offer.

4. Payments & Invoicing
4.1 Payment Term: The payment term indicated on the invoice is used unless otherwise agreed.
4.2 Payment Verification: Services are activated upon payment verification, automated by our system.
4.3 Suspension for Non-Payment: Services are automatically suspended when invoices are not paid.
4.4 Right of Withdrawal: The right of withdrawal begins at the service activation and lasts 14 days, following the process specified in Article 10, paragraph 1, with exceptions.
4.5 Custom Services: The right of withdrawal is not valid for custom spec-to-order services, such as custom dedicated servers and custom VPS products.

5. Intellectual Property
5.1 Indicative Content: Images, illustrations, texts, videos, etc., provided by Retslav Hosting are indicative and do not warrant a termination of the agreement or return of payment.
5.2 Copyright: Copyright applies to all visual and textual content provided by Retslav Hosting.

6. Liability
6.1 Service Interruptions: Retslav Hosting is not liable for damage resulting from service interruptions or maintenance.
6.2 Personnel Liability: Retslav Hosting is not liable for damage incurred by its personnel.

7. Force Majeure
7.1 Force Majeure Events: Force majeure includes errors of suppliers of Retslav Hosting, interruptions, malfunctions, attacks, fires, water damage, internal problems, licensing issues, DDoS attacks, and more.
7.2 Termination in Force Majeure: If a force majeure situation lasts longer than 30 days and still affects the service after this period, both parties may terminate the agreement, without reimbursement.

8. Technical
8.1 Server Locations: Retslav Hosting's servers are located in various data centers, including but not limited to Equinix AM5, Cellnex Wormer, and more.
8.2 Backups: Retslav Hosting performs irregular backups and is not obligated to make regular backups or restore them.
8.3 Maintenance: Irregular maintenance is conducted, both physically and remotely, without prior notice.
8.4 Excessive Use: Retslav Hosting reserves the right to suspend services or charge additional fees for excessive use.

9. Pricing
9.1 Indicative Prices: Prices on Retslav Hosting's platforms are indicative and subject to errors.
9.2 Price Adjustments: Price adjustments will apply to the next invoice.
9.3 Currency: All prices on Retslav Hosting's platforms are in Euro and exclude VAT.
9.4 Price Adjustment Notice: Retslav Hosting may adjust prices with at least 14 days' notice to customers.

10. Use
10.1 Legal Use: Customers are prohibited from using Retslav Hosting's services for illegal purposes, such as DDoS attacks, hate speech, and other activities contrary to Dutch law.
10.2 Measures Against Misuse: Retslav Hosting may take necessary measures to prevent nuisance, damage, or other dangers to its services or networks due to customer actions.
10.3 Damages: Customers are liable for damages resulting from violations of these Terms of Use and must indemnify Retslav Hosting for third-party claims related to such violations.

11. Communication
11.1 Communication Channels: Retslav Hosting communicates through its internet sites, social media channels, email addresses, and Discord server.
11.2 Contact: Retslav Hosting can be reached at [email protected] and via the communication channels mentioned above.

12. Definitions
12.1 Customer: The purchasing party of Retslav's services.
12.2 Retslav Hosting: The company registered as "Retslav" under Chamber of Commerce number 88614077, located at Twikkerlerweg 1, Markelo.
12.3 Personnel: All employees of Retslav Hosting.
12.4 Management: The officers holding positions such as Chief Executive Officer, Chief Operational Officer, Chief Financial Officer, and System Administrator at Retslav.
